Sacked Saks Fifth Avenue Saleswoman Fined, Jailed for Stealing

She was sentenced to 90 days in jail and a $96,000 fine, reports WWD. She's also been given five years probation and 100 hours of community service.
Villacorta was consistently ranked among top earners, and through the falsified business records, improperly received $48,500 in commissions. She was acquitted of handing out $1.4 million in discounts. Wow!
Villacorta, who was fired in 2006 after the retailer implemented cost cuts in 2005, has filed a civil lawsuit against Saks for malicious prosecution. A Phillipines native, Villacorta faces deportation after serving her sentence.
According to defense attorney Joseph Tacopina, Villacorta was not the only Saks employee using these practices, and in fact, the company authorized those practices. He said that another employee was willing to testify to that effect, but was threatened with prosecution by the district attorney's office if she did.

The sentence is stayed and the appeal granted immediately after sentencing. The civil case referred to is represented by Phillips Nizer, LLP; the same law firm that represented plaintiff International Design Concepts, in IDC vs Saks, commonly referred to as the "vendor markdown scandal" wherein Saks pled guilty & a federal district judge ordered Saks to pay about $48 million in fines. This so-called 'landmark' case was used by the SEC in their own case against Saks, again Saks was found guilty and sentenced to probation, as I recall. Other vendors have followed suit (sic), these are all matters of public record...
