L'Oreal Beats Knockoff Scents in Court

We've all had a run-in with a "designer imposter" fragrance or two -- occasionally it's in the bathroom of a club, and sometimes it's when we're trapped in an elevator with the woman who wore too much. It's never good, so we're thrilled to hear that L'Oréal has won their case against three firms that copied some of L'Oréal's top perfumes!

WWD reports that the three firms -- Bellure, Malaika and Starion -- manufactured, imported and distributed knockoffs of popular L'Oréal fragrances like Trésor, Anaïs-Anaïs and Noa in the U.K. Yesterday, the European Court of Justice ruled in L'Oréal's favor.

Naked Cowboy vs. Blue M&M

Trademark lawsuits are usually as boring an emotionless as the corporate legal teams that file them, but when the case involves Time Square's Naked Cowboy, things can get a little more colorful. The Naked Cowboy, who's real name is Robert Burck, got the go-ahead from a federal judge yesterday to sue M&M for stealing his unique sense of style. In specific, the blue M&M infringed on the Robert's rights when he appeared on video billboards in Times Square wielding a six string and wearing nothing but boots, briefs, and a cowboy hat.

Apparently, the judge said that they Burck's trademark rights weren't violated -- which is a bummer -- but that he could go ahead seeking $4 million in damages from M&M Mars for leading people to believe that he endorsed the product. After the ruling, Burch told The Post that it "Sounds like I've got $4 million coming my way." That's a pretty good payday for a guy who strums a guitar on the side of the road -- clothed or naked.

Battle of the oldies: Levi versus Lauren

Last week Lauren reported that Gwen Stefani was suing Forever 21 for knocking off her designs. Today Vogue UK brings news of a similar suit, although not one as young and trendy. Levi has filed a lawsuit Polo Ralph Lauren claiming that Lauren is copying their pocket stitching. The Vogue article says that Lauren has imitated their trademark "arcuate" pocket stitching. Arcuate? I'll admit I didn't know the word so I looked it up. It basically means curved or arched. The jeans design is the oldest known apparel trademark in the US, protected since 1873 so Ralph and his team have some explaining to do. It would be very hard to claim ignorance of one of the most recognizable design styles.

Angelina and Shiloh® in a perfume name dispute

Sure, 'Shiloh' is not the most popular baby name in the world, but does obscurity give Angelina Jolie and her daughter Shiloh blah blah blah Jolie-Pitt the right to trademark it?

Symine Salimpour certainly doesn't think so. Symine Salimpour's company Hors Lá Monde has created a perfume of the very same famous baby name. To protect her daughter's name, Jolie filed a notice of opposition with the U.S. Trademark and Patent Office.

"The notice of opposition alleges that you will be damaged by the pending trademark," says Thomas M. Wilentz, a trademark attorney in New York City. "Angelina must feel that people applying for 'Shiloh' need to get her consent."

An insider close to Salimpour says the perfume has been in development for nearly two years, so it was obviously not named after the Shiloh of Brangelina fame. "The name is completely unrelated," the insider says. "Symine is citizen of both France and Israel, but she identifies strongly with her Israeli roots - it's a spiritual thing for her. Shiloh is a Hebrew name that means 'his gift.'"
